Enduring Power of Attorney

An Enduring Power of Attorney allows a nominated person to manage your financial and legal affairs when you are not able to. This could include if you lose your capacity to make decisions about your financial and legal affairs or if you are temporarily unable due to a medical issue. Ensuring that there is a trusted person to manage your affairs whilst you are unable is important and reduces the inevitably issues or disputes that may arise if you have not appointed someone.

Our team can assist in preparing your appointment of an Enduring Power of Attorney and ensure that suitable limits, restrictions and conditions are included to give you peace of mind that your assets and affairs will be appropriately managed if you are not able to.

Enduring Guardian

An Enduring Guardian is similar to an Enduring Power of Attorney but relates to your medical and lifestyle decisions. If for any reason you are unable to make medical decisions for yourself, your Enduring Guardian will make these decisions for you. Generally, a doctor will need to determine that you cannot make these decisions for yourself before your Enduring Guardian can act. Without an Enduring Guardian, your medical practitioners may not be able to get instructions on how to care for you or disputes may arise about what care you should receive.

We have experienced lawyers who can guide you through the process and ensure that in the unfortunate situation where you can’t make these decisions, your wishes can be respected by a trusted Enduring Guardian. To discuss an appointment of an Enduring Guardian or for any other estate planning needs, contact our team today.

Advanced care directive/medical direction

An advanced care directive/medical directions is a document that sets out your wishes if you become seriously ill or injured. It allows you to set out the type of care and treatment you would wish to receive in these situations and ensure that your wishes are respected when you may be unable to say what you want.

The advance care directive tells your Enduring Guardian and treating medical practitioners exactly what type of care you what in these situations and ensures that you do not receive medical care or treatment which you would not have agreed to if you could communicate your wishes.

Our experienced estate planning lawyers can assist you in preparing your advanced care directive as part of your wider estate planning needs. Get in contact with us today to discuss all your estate planning needs.
